By submitting your article (“the Article”) to AK Publishing LLC and EmpoweringHumanityMagazine.com, you agree to the following terms:
Approval and Discretion: The publication of your Article is not guaranteed. Our editorial team will carefully review each submission and make the final decision on publication. If your Article is rejected, we will notify you. If your Article is published, we will share the published magazine issue with you.
2. Original Content: You represent and warrant that the Article is your original work and that you hold all rights to it, regardless of any prior publication. You further represent that the Article, including any submitted photographs, does not infringe on the rights of any third party. You confirm that you have obtained all necessary rights, permissions, and releases for any submitted photographs. Should any third party assert claims related to the Article or photographs, you agree to address such claims directly and indemnify AK Publishing LLC, EmpoweringHumanityMagazine.com, its affiliates, directors, officers, employees, and agents from any related claims, damages, liabilities, costs, and expenses, including reasonable attorney’s fees.
3. No Compensation and Publicity: You acknowledge that your submission is voluntary and that there is no financial compensation for your Article, whether it is published or not. By contributing, you gain access to our global readership to share your expertise, services, or products. Articles should contain 95% content and 5% information about your work, services, or offerings, and should not be treated as advertisements.
4. Editorial Process: After submission, your Article will be reviewed and edited by our team. If you wish to view the edited version before publication, you must notify us upon submission or request. We will provide the edited version for your review before final publication if requested. You have five (5) business days to request minor changes at no cost. After this period, changes will incur a fee of up to $195. Changes will only apply to the digital version; printed versions are final. You may submit minor changes within three (3) days after initial approval.
5. Use of Additional Visual Content: AK Publishing LLC reserves the right to select, modify, and use additional images or visual content to complement your Article at its discretion. You grant permission for AK Publishing LLC and its design team to choose and use such content without needing further approval from you. You agree not to hold AK Publishing LLC liable for the use of additional visual content that is selected to enhance the presentation of your Article.
6. Confidentiality: Both parties agree to keep any proprietary or sensitive information confidential until the Article is published.
7. Rejection Clause: If the Article is rejected, you agree not to hold AK Publishing LLC, EmpoweringHumanityMagazine.com, or its affiliates liable for any perceived damages, including missed opportunities or loss of potential income.
8. Revisions by Contributor: If significant revisions are made to the Article after submission, the editorial team reserves the right to re-review and potentially reject the revised Article.
9. Plagiarism and Ethics: AK Publishing LLC adheres to a strict anti-plagiarism policy. Any breach will result in rejection of the Article and may bar you from future submissions.
10. Termination of Agreement: Either party may terminate this agreement before publication if there are significant editorial differences or if deadlines are not met. Termination must be communicated in writing.
11. Indemnification: You agree to indemnify and hold harmless AK Publishing LLC, EmpoweringHumanityMagazine.com, its affiliates, directors, officers, employees, and agents from any claims, damages, or liabilities arising from a breach of this agreement.
12. Rights and Distribution: By submitting your Article, you grant AK Publishing LLC a non-exclusive, royalty-free, perpetual, and worldwide license to distribute and promote your work. This includes, but is not limited to, publication on EmpoweringHumanityMagazine.com, our blog, partners’ blogs, affiliated websites, social media, and digital magazine platforms such as Zinio.com and their affiliates. AK Publishing LLC also reserves the right to print and sell the magazine, including your Article, on its website or through other sales channels. You agree not to hold AK Publishing LLC liable for the appearance or sale of your Article on these platforms or in printed formats.
13. Successors and Assigns: This agreement is binding upon and will benefit AK Publishing LLC and its successors or assigns. All rights and licenses granted under this agreement will remain valid and enforceable in the event of a sale, merger, or transfer of ownership of the company.
14. Limitation of Liability: AK Publishing LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the publication or non-publication of the Article.
15. Force Majeure: AK Publishing LLC is not responsible for any failure to meet its obligations due to events beyond its control, such as natural disasters, strikes, or other unforeseen circumstances.
16. Right to Modify Terms: AK Publishing LLC reserves the right to modify the terms of this agreement with prior notice to contributors.
17. Conflicts of Interest: Contributors must disclose any conflicts of interest related to the content they submit.
18. Severability: If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
19. Entire Agreement: This agreement constitutes the entire understanding between the parties regarding the submission of the Article and supersedes any prior agreements or understandings, whether written or oral.
20. Governing Law and Jurisdiction: This agreement shall be governed by the laws of the State of Nevada. Any legal action arising out of this agreement shall be brought exclusively in the state or federal courts located in Las Vegas, Nevada.
21. Legal Fees: In the event of a dispute, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs from the non-prevailing party.
22. Contributor Acknowledgment: By submitting the Article, you acknowledge that you have read, understood, and agree to all the terms outlined in this agreement.
